This page and referenced policies tells you the terms of use on which you may make use of our website www.nhsherosupport.co.uk (“NHSHeroSupport”).

Please read these terms of use carefully before you start to use the site. By visiting NHSHeroSupport, you indicate that you accept these terms of use and that you agree to abide by them

Information about us

www.nhsherosupport.co.uk is a site operated by NHSHeroSupport (“We”).

We are a volunteer organisation, providing volunteer and donor services, operating in England and Wales. As a result, we are not regulated under employment law and in the UK, the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003 or other employment agency laws do not apply to us.


Accessing our site

We reserve the right to withdraw and amend the services we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our site, or our entire site, to visitors.

If you are under the age of 18, you may not use the services on our website. We reserve the right to refuse to offer the services to any person or entity and change eligibility criteria at any time. Where these terms or use of the services is prohibited or conflicts with any applicable law, rule or regulation, the right to access the services is revoked.

You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms, and that they comply with them.


Reliance on information posted

Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site, or by anyone who may be informed of any of its contents.


Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.


Our liability

We try to keep NHSHeroSupport running at all times, but we cannot guarantee to do so. We cannot guarantee continuous, uninterrupted or secure access to the Website as it may be interfered with by factors outside of our control.

We also try to make sure that all the information that we place on NHSHeroSupport is accurate, but we cannot guarantee this either.

To the extent permitted by law, we and third parties connected to us hereby expressly exclude:

All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including:

  • loss of income or revenue;

  • loss of business;

  • loss of profits or contracts;

  • loss of anticipated savings;

  • loss of data;

  • loss of goodwill;



Disclaimer for Volunteers

NHSHeroSupport is a volunteer organisation which has been set up in this time of national crisis to help deliver idle Personal Protective Equipment to frontline NHS staff and other care workers.

Volunteering and the activities connected with it are undertaken at your own risk. NHSHeroSupport seek to ensure the safe handling of equipment to prevent the spread of coronavirus but whilst volunteering NHSHeroSupport cannot accept any responsibility or liability for any illness, injuries or personal or property damage howsoever caused to you or anyone connected with you including contracting coronavirus or related conditions which may occur during or in any way connected to volunteering.

If you require the use of a third party to assist you they will need to become an official volunteer with us. Please inform us so that they sign the necessary disclaimer to be a volunteer and undergo the required induction.

NHSHeroSupport may at times use the assistance of couriers, of which we have no responsibility for. As such, NHSHeroSupport cannot take any responsibility or liability caused through this third party, including responsibility or liability for any illness, injuries or personal or property damage howsoever caused including contracting coronavirus or related conditions cannot take responsibility for your personal security either in relation to any activities you undertake with us. NHSHeroSupport is collaborating with third parties so your data that you share with us may also be shared with these third parties.



Disclaimer for Donors

NHSHeroSupport is a volunteer organisation which has been set up in this time of national crisis to help deliver idle Personal Protective Equipment to frontline NHS staff and other care workers. Any activities connected with your participation are undertaken at your own risk. NHSHeroSupport seeks to ensure the safe handling of equipment to prevent the spread of coronavirus but whilst participating in our programme NHSHeroSupport cannot accept any responsibility or liability for any illness, injuries or personal or property damage howsoever caused including contracting coronavirus or related conditions to you or anyone else connected with you which may occur during or in any way connected to your participation.

If you require the use of a third party to assist in handling and delivery or any other form of assistance with your participation to this organisation, we strongly advise that you advise them on safe handling as included in our instructions to prevent the spread of the virus. We recommend that where possible you limit the number of third parties involved for this reason. NHSHeroSupport cannot take any responsibility or liability for any third involvement brought in by yourselves, including responsibility or liability for any illness, injuries or personal or property damage howsoever caused including contracting coronavirus or related conditions to either yourselves or the third party. NHSHeroSupport may at times use the assistance of third party couriers, of which we have no responsibility for. As such, NHSHeroSupport cannot take any responsibility or liability caused through this third party, including responsibility or liability for any illness, injuries or personal or property damage howsoever caused including contracting coronavirus or related conditions. NHSHeroSupport cannot take responsibility for yours or any other third party's personal security either in relation to any activities you or anyone connect to you undertake with us. NHSHeroSupport is collaborating with third parties so your data that you share with us may also be shared with these third parties.



Disclaimer for Recipients

We strongly advise that you make the user of the PPE and all necessary parties affiliated with your organisation aware of this disclaimer.

NHSHeroSupport is a volunteer organisation which has been set up in this time of national crisis to help deliver idle Personal Protective Equipment to frontline NHS staff and other care workers. We facilitate donations and supply but neither you nor we have any contractual obligations to each other.

NHSHeroSupport and their donors and volunteers cannot take responsibility or liability for any failure of the equipment or damage, nor can we assume responsibility or liability should you or anyone connected with you including any individuals within your organisation or the user of the equipment or anyone connected with them contract the SARS-CoV-2 virus or suffer any other illness, injury or damage as a result of participation with our scheme. Our role is not to substitute the usual supply chain but to help support key workers facing shortages by accepting donations. For this reason the equipment may not be the standard PPE with which workers are familiar with.

As such, NHSHeroSupport cannot take responsibility or liability for any failure of the equipment or damage, nor can we assume responsibility or liability should you or anyone connected with you, including any individuals within your organisation or the user of the PPE or anyone connected with them contract the SARS-CoV-2 virus or suffer any other illness, injury or damage as a result of the use of the equipment or during delivery or handling of the equipment.


Visors

We are working in collaboration with the national 3D printing society who are making 3DVerkstan visors and Prusa Protective face shields: https://national3dprintingsociety.co.uk/medical-am-covid-19/ through independent providers of 3D equipment. Given the current national crisis these visors have not gone through the standard checks that is required for PPE. Recipients and users of these products must acknowledge that these products have not been tested and validated in the UK, the products are designed for single use only, the products have not been tested for sterilisation with standard autoclaving or common disinfectants.

Recipients must acknowledge that neither NHSHeroSupport nor the National 3D Printing Society and their independent providers and affiliates assume responsibility or liability should you or anyone connected with you including any individuals within your organisation and the user of the PPE or anyone connected with them contract the SARS-CoV-2 virus or suffer any injury or damage as a result of the use of the equipment, nor can NHSHeroSupport or the National 3D Printing Society and their independent providers and affiliates assume responsibility or liability should the products fail. You will only receive the equipment from the National 3D Printing society if you have requested it.


Scrubs

Please acknowledge that the scrubs provided may be made by our volunteers and neither NHSHeroSupport nor the volunteers can take responsibility or liability for any failure of the equipment or damage, nor can we assume responsibility or liability should you or anyone connected with you, including any individuals within your organisation and the user of the equipment or anyone connected with them contract the SARS-CoV-2 virus or suffer any other illness, injury or damage as a result of the use of the scrubs.


Cleaning and storage

The PPE delivered will be handled by our volunteers or by independent donors. We strongly recommend that the PPE is cleaned and stored appropriately after it is delivered as we cannot guarantee that it will be free of the SARS-CoV-2 virus or any other pathogens. You should only use the PPE in line with the guidance provided by the WHO and Department of Health.


Standards

Whilst we will seek, as far as possible, to ensure the PPE we provide meets regulatory standards, we cannot accept any liability howsoever arising for any failure in the PPE, which includes potential transmission of the SARS-CoV-2 virus or any other pathogens, thus it must be checked by you to ensure it meets required standards and the needs of the use to which it is put.

Please note that in some circumstances the PPE will have been brought in from abroad or from third party collaborators and we will not be able to guarantee that they meet the required standards or that they have been handled in a manner that removes pathogens such as SARS-CoV-2. As such, NHSHeroSupport cannot take responsibility or liability for any failure of the equipment or damage, nor can we assume responsibility or liability should you or anyone connected with you including any individuals within your organisation the user of the equipment or anyone connected with them contract the SARS-CoV-2 virus or suffer any other illness, injury or damage as a result of the use of the equipment.


Delivery and collection of PPE

At times we may use a third party courier service for which we have no responsibility for. As such NHSHeroSupport cannot assume responsibility or liability should you or anyone connected with you including associates within the organisation or the user of the equipment or anyone connected with them contract the SARS-CoV-2 virus or suffer any other illness, injury or damage when the equipment is delivered or by handling of the equipment.

Please also be aware that in times when the recipient (yourselves or a representative from your organisation) collects the PPE, neither NHSHeroSupport nor the donor nor the volunteer will be able to take any responsibility or liability should you or anyone connected with you or any other representative from the organisation contract the SARS-CoV-2 virus or suffer any other illness, injury or damage during the collection, delivery and handling.

Whilst we will process your request as quickly as possible please note that we are a small organisation and may not be able to comply with your request.

NHSHeroSupport cannot take responsibility for your personal security either in relation to any activities you undertake with us.

NHSHeroSupport is collaborating with third parties so your data that you share with us may also be shared with these third parties. By clicking the box you acknowledge that you have read this disclaimer and are agreeing to these conditions.



Information about you and your visits to our site

We process information about you in accordance with our privacy policy. By using our site, you consent to such processing and you warrant that all data provided by you is accurate.


Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged if you intend to utilise it elsewhere, with our permission.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page without our express permission. We reserve the right to withdraw linking permission without notice.

Governing Law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country.

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
